Part A: Terms and Conditions of Use

1. Introduction

Welcome to our website. If you continue to browse and use this website, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our Privacy Policy govern ROAG's relationship with you in relation to this website.

The term "ROAG" or "us" or "we" refers to the owner of the website. The term "you" refers to the user or viewer of our website.

The use of this website is subject to the following terms of use:

  • The content of the pages of this website is for your general information and use only. It is subject to change without notice.
  • Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness, or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
  • Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services, or information available through this website meet your specific requirements.

2. Supply of Goods and Services (Electronic Transactions Act 2000)

Insofar as this Agreement falls within the ambit of the Electronic Transactions Act 2000, the following information is made available to you in respect of the supply of goods and/or services offered for sale, hire, or exchange by way of an electronic transaction:

  • Goods and/or Services: The services provided by ROAG through the website enable you to interact with various clubs as well as to enter sporting events. These services are primarily offered through third parties (Event Organisers) that provide their respective services directly to you. ROAG may provide some services directly to you.
  • Delivery Policy: Subject to availability and receipt of payment, event entry requests will be processed immediately and delivery confirmed by way of email confirmation.
  • Return and Refunds Policy: No refunds or returns will be considered by ROAG. All event entries are final. Any refund requests must be directed to the specific third-party Event Organiser and will be subject to their individual event policies.
  • Payment & Security: If you elect to purchase entry services, payment will be processed via an authorized Mauritian payment portal. Credit and debit card payments are securely handled by the Mauritius Commercial Bank (MCB) or our designated secure payment gateway, governed by their respective terms and privacy policies. You will be transferred to a secure connection using Secure Socket Layer (SSL) encryption to enter card details.
  • Customer Details Separation: ROAG does not store your credit or debit card details. Customer profile details will be stored by ROAG separately from any secure pages that process financial transactions.
  • Transaction Currency: The transaction currency for presenting payment options to the cardholder in Mauritius is the Mauritian Rupee (MUR).
  • Complaints and Disputes: We invite you to file complaints with us via the "Contact Us" service of the website at www.roag.org or by emailing [email protected].

3. Use of the Site

You agree to use the Site for lawful purposes only. If you choose to access or use this Site from locations other than the Republic of Mauritius, you do so at your own initiative and you are responsible for compliance with applicable local laws.

You are prohibited from posting or transmitting through the Site any content which is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, or racially, ethnically, or otherwise objectionable, which includes but is not limited to:

  • Any content that encourages conduct that would constitute a criminal offence, give rise to civil liability, or otherwise violate any applicable local or international law;
  • Any content that constitutes an invasion of privacy or a breach of the Data Protection Act 2017;
  • Any content that is an infringement of any intellectual property right;
  • Any content that contains software viruses or malicious code; or
  • Any content that constitutes an unauthorized political statement, commercial solicitation, or "Spam".

Although ROAG does not undertake to review (nor is it under any obligation to review) submitted content, it reserves the right to remove any content from the Site where it deems such content, in its sole and absolute discretion, to be an infringement of these terms or harmful in any way whatsoever. Should you breach any clause in these Terms and Conditions, ROAG may immediately terminate or suspend your access to the Site without further notice.

You warrant that you own or control all rights to any content you submit; that use of the content will not cause injury to any person; and that you will indemnify ROAG, its directors, and employees for all claims resulting from your submitted content. By submitting content (excluding personal data), you grant ROAG a royalty-free, perpetual, irrevocable right to use, reproduce, and distribute it worldwide.

The following activities are expressly prohibited:

  • Any non-personal or commercial use of automated systems (robots, spiders, scrapers) to monitor or copy portions of the Site without prior written authority;
  • The collection of descriptions or price lists for the benefit of a competing merchant;
  • Any action that imposes an unreasonable load on the infrastructure, interferes with the proper functioning of the Site, or attempts to gain unauthorized access to related networks; and
  • Reverse engineering or decompiling the Site to build a competitive product.

You are responsible for maintaining the confidentiality of your User Name and Password and accept full liability for all activities that occur under your account.

4. Intellectual Property

All content included on this website, such as text, graphics, logos, icons, images, photographs, databases, and software, is the property of ROAG or its content suppliers and is protected by Mauritian and international copyright laws. The compilation of all content on this site is the exclusive property of ROAG.

Except as stated herein, none of the material may be copied, reproduced, distributed, republished, downloaded, or transmitted in any form or by any means without the prior written permission of ROAG. You may not "mirror" any content contained on this Site on any other server.

You are granted a limited, revocable, and non-exclusive right to create a hyperlink to the home page of the Site, provided the link does not portray ROAG or its services in a false, misleading, or offensive manner. You may not use any ROAG logo or proprietary graphic as part of the link without express written permission.

5. Limitation of Liability

You note that various elements of the ROAG service are provided by third parties (such as independent sporting clubs and event organizers). We are therefore unable to guarantee that such services, or websites accessible via links, are entirely virus or error-free. We caution you to check all files and downloads. Your dealings with merchants or event hosts found via ROAG are solely between you and that third party.

While we make reasonable efforts to ensure that information provided by us is accurate at the time of inclusion, there may be errors or omissions for which we exclude liability. Information provided on this Site does not constitute legal or professional advice and should not be relied upon without independent verification.

6. Our Liability to You

ROAG shall not be liable to you in contract, tort (including negligence), or otherwise:

  • For any amount in respect of damage or loss arising from viruses received via the website, or from a failure to provide the service, in excess of the exact amount received by ROAG from you as payment for the specific transaction under dispute;
  • For any economic losses, indirect, special, or consequential loss, loss of data, loss of profit, goodwill, or reputation;
  • For any failure to perform our obligations properly as a result of an event beyond our reasonable control (Force Majeure), including strikes, acts of God, war, civil action, pandemics, compliance with any law or governmental order, equipment or telecommunication service failures.

Each provision of this clause operates separately. If any part is held by a court to be invalid or inapplicable, the remaining parts shall still apply in their entirety.

7. Changes, Suspension, and Termination

We may alter, amend, suspend, or terminate the ROAG service at any time without giving notice to you. ROAG may terminate your account at any time for improper use or failure to comply with this Agreement.

ROAG may modify these Terms and Conditions at any time, and your continued use of the site is conditional upon the terms in force at the time of your use. You are advised to review these terms each time you visit the site.

Part B: ROAG Privacy Policy

1. Commitment to Data Protection

ROAG's online service is committed to protecting the privacy of our users. We want to provide a safe and secure user experience. We ensure that the information you submit to us via our webpage at www.roag.org remains private and is only used for the purposes set out in this policy in accordance with the provisions of the Mauritius Data Protection Act 2017 (DPA 2017).

1.1. ROAG recognises the importance of protecting your privacy in respect of your personal data collected by us when you use the ROAG site and commits itself to complying with the DPA 2017.

1.2. In adopting this Privacy Policy, we balance our legitimate business interests and your reasonable expectation of privacy. Accordingly, we take appropriate, reasonable technical and organisational measures to prevent unauthorised access to, or disclosure of your personal data, and will notify the Data Protection Commissioner and you of any high-risk data breach within 72 hours in accordance with Section 37 of the DPA 2017.

1.3. Your use of our services signifies your freely given, specific, informed, and unambiguous consent to us collecting and processing personal data about you as specified below. You retain the right to withdraw this consent at any time.

1.4. In using or continuing to use the ROAG site, you consent to the collection, collation, processing, storage, and destruction of your personal data for the following purposes:

  • 1.4.1. Providing you with full functionality associated with ROAG's online service;
  • 1.4.2. Fulfilling any of ROAG's legal obligations under Mauritian law; and
  • 1.4.3. Fulfilling the legitimate purposes of ROAG's business, provided these do not override your fundamental rights and freedoms.

2. Types of Personal Data Processed

The following types of personal data are processed by us:

  • 2.1. Standard Personal Data: Your name, identity number or passport number, email address, physical and postal addresses, contact information, age, race entry information, race results, age classifications, and photographs or videos of participants taken during events.
  • 2.2. Special Categories of Personal Data: In accordance with Section 2 of the DPA 2017, this includes data relating to your physical or mental health conditions, medical aid information, prescription medication, medical assessment results, or biometric data necessary for event safety and timing verification.

3. Collection and Processing of Data

Personal data is collected when you register as a member, use the site facilities, or register for events. It is also generated automatically when event results are uploaded periodically during and at the end of an event.

We process this data to verify your identity, record and track your event results over time, maintain member and sponsor relationships, monitor web traffic for internal review, and ensure administrative, medical, and security safety at events.

4. Disclosing Your Information to Third Parties & Cross-Border Transfers

4.1. By virtue of the nature of ROAG's business, we share relevant personal data with Event Organisers, Timing Companies, Medical/Health Organisations registered with us, and approved Charities associated with your selected events. This disclosure is strictly aligned with the operational requirements and performance of the contract you enter into when registering for an event.

4.2. ROAG may engage service providers to perform functions on our behalf. These companies are strictly bound by confidentiality obligations and processing agreements that implement the data safeguards required under the DPA 2017.

4.3. Cross-Border Transfers: If your personal data is transferred to servers outside the borders of Mauritius, ROAG ensures that the destination country provides an adequate level of protection, or that appropriate safeguards (such as standard data protection clauses) are established in compliance with Section 36 of the DPA 2017.

5. Your Rights as a Data Subject

As a data subject in Mauritius, you hold comprehensive rights under the DPA 2017. You may exercise these rights by submitting a formal request to our team at [email protected]:

  • Right of Access (Section 41): You have the right to obtain confirmation from us as to whether your data is being processed, and to obtain a copy of your personal data free of charge.
  • Right to Rectification (Section 42): You have the right to request that any inaccurate, outdated, incomplete, or misleading data be updated or corrected without undue delay.
  • Right to Erasure / "To be Forgotten" (Section 43): You have the right to request the erasure or destruction of your personal data where the data is no longer necessary, consent has been withdrawn, or the processing is unlawful.
  • Right to Restriction of Processing (Section 44): You can request that we restrict the processing of your data under specific conditions, such as while verifying accuracy or investigating an objection.
  • Right to Data Portability (Section 45): You have the right to receive your personal data in a structured, commonly used, and machine-readable format, and have the right to transmit that data to another controller.
  • Right to Object (Section 46): You have the right to object at any time, on reasonable grounds relating to your situation, to the processing of your data, including direct marketing.
  • Automated Decision-Making: You have the right not to be subjected to a decision based solely on automated processing or profiling that produces legal or significantly disruptive effects concerning you.

6. Use of Cookies

The ROAG site uses cookies. A cookie is a small data file sent from a web server to a web browser. Cookies are utilized to remember your login status, track web traffic on an anonymous, aggregate basis, and preserve temporary session information. Most browsers allow you to disable cookies through their help menu settings; however, switching off cookies may restrict your full use of our website capabilities.

7. Governing Law and Jurisdiction

These terms, conditions, and privacy policies shall be governed exclusively by the laws of the Republic of Mauritius. You expressly consent to the jurisdiction of the District Court of Upper Plaine Wilhems or the Supreme Court of Mauritius in the event of any legal dispute arising from this Agreement.

If you believe that ROAG has processed your personal data in violation of the law, you have the right to lodge an official complaint with the local regulatory body:
